City of Aurora v. David Allan

Kent Municipal Court, Kent, Ohio

Mr. Gibbons was retained to represent a young, middle-school teacher against Impaired Driving charges brought by the Aurora Police Department in the Kent Municipal Court.  Mr. Gibbons investigated the circumstances of the arrest and filed a Motion to Suppress Evidence arguing that the arresting officer did not even have Probable Cause to stop the vehicle.  Based upon the merits of that Motion, the Aurora Municipal Prosecutor agreed to reduce the charges in a beneficial Plea Bargain which allowed the young teacher to minimize his punishment and maintain his employment at a local Portage County School District.
