United States of America v. Matthew Groth

Mr. Gibbons was retained by Mr. Groth to represent him in a criminal action brought by the United States Attorney in Federal Court in Cleveland, Ohio. Mr. Groth was formerly employed by a national wireless cell phone company as a commercial sales representative. He was terminated from his employment when his employer alleged that he caused a commercial customer to order extra,unneeded cell phones, recovered those phones from the customer and later resold the phones on eBay. The employer chose not to bring a civil suit against their former sales representative. Instead, the facts were turned over to the FBI and the United States Attorney. Nearly five years passed between the incident and Indictment which alleged mail and wire fraud. Mr.Gibbons was able to negotiate a beneficial plea agreement which resulted in the imposition of probation, house arrest and restitution. Mr. Gibbons’ client remained free of Federal prison and is successfully pursuing his sales career.
