James P. Frazier was convicted and sentenced to Death Row by a Jury in the Common Pleas Court for Lucas County, Ohio. His conviction was affirmed by the Ohio Supreme Court. (See State v. Frazier, 115 Ohio St.3d 139) Thereafter, Judge Patricia A. Gaughan of the District Court appointed Mr. Gibbons and his co-counsel to represent Frazier in Habeas Corpus proceedings in the United States District Court. The primary issue in Federal Court is the question of whether Frazier, who has a low IQ,can be considered legally mentally retarded and therefore, not constitutionally eligible for the imposition of the Death Sentence. After being denied relief by the District Court, Mr. Gibbons and his co-counsel took Frazier’s case to the United States Court of Appeal for the Sixth Circuit. Oral argument on his case was conducted on November 18, 2013 in Cincinnati, Ohio. A decision on Frazier’s case is pending.
