Court of Common Pleas for Cuyahoga County, Ohio

Mr. Gibbons represented Thomas Michael Keenan, a Death Row Prisoner in one of the most publicized ongoing criminal cases tried in Cuyahoga County.  In 1989,Keenan, as well as his Co-Defendant, Joseph D’Ambrosia, was convicted of Aggravated Murder and the Death Penalty was imposed on both Defendants in the first trial.  Keenan’s conviction was overturned by the Ohio Supreme Court due to Prosecutorial misconduct (See Statev. Keenan, 66 Ohio St.3d 402). A second trial, in 1994, again resulted in Keenan’s conviction and the re-imposition of the death sentence.  Keenan was on Ohio’s Death Row for twenty-four years.  Litigation in the Federal Courts resulted in the discovery of substantial Exculpatory Evidence which was withheld from his original trial Attorneys by the Cleveland Police Department and the Cuyahoga County Prosecutors.  The Federal Court granted both Keenan and his Co-Defendant new trials (See Keenan v. Bagley, 2012 U.S. Lexis57044).  Joseph D’Ambrosia’s prosecution was dismissed by a State Court Judge and he was set free.  Mr. Gibbons with his co-counsel represented Keenan on his court ordered retrial. Judge John J. Russo of the Common Pleas Court eventually granted Keenan’s Motion to Dismiss the Indictment based upon cumulative Prosecutorial Misconduct that deprived him of the opportunity to ever receive a fair trial.  Keenan was set free after spending twenty-four years on Death Row. The decision of the trial court was recently affirmed by the Eighth District Court of Appeals in State v. Keenan, 2013 Ohio 4029, and his case was featured on The Discovery Channel program “Lockup.”  An article located in the Cleveland Plain Dealer featured a story as well located in the following link:
